3DCONNEXION PROMOTION FOR AUTODESK UNIVERSITY 2011
PROMOTION OFFICIAL RULES
NO PURCHASE NECESSARY TO WIN. OFFER VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
1. ELIGIBILITY. The promotion is open to people 21 years of age or older (as of the date of entry) residing in the 50 United States. Employees of 3Dconnexion Inc including their respective affiliates, and subsidiaries, and immediate family members of employees are not eligible.
2. HOW TO ENTER. First, go to www.3dconnexion.com/au2011 and fill out the information requested and your use of 3D software and 3D mice by November 7, 2011 to be entered into a drawing for a trip to Autodesk University 2011 Conference and Exposition, and a SpacePilot PRO 3D mouse.
3. PROMOTION PERIOD AND SELECTION OF WINNER. The promotion begins on October 3, 2011 and runs through November 7, 2011 (“Promotion Period”). One winner will be randomly drawn on or about November 8, 2011 from the eligible entries received during the Promotion Period. Odds of winning depend on the number of eligible entries received.
Winner will be contacted via email the day of the drawing. Winner will have 3 days to claim the prize, and should the prize go unclaimed, another winner will be drawn from the remaining eligible entries.
4. PRIZE. The Winner will be awarded one (1) SpacePilot PRO 3D mouse, one (1) full conference pass to the Autodesk University 2011 Conference and Exposition currently scheduled for November 29 through December 1 2011 in Las Vegas, NV, round trip coach airfare (to and from Las Vegas, NV) and 3 nights accommodations (approximate retail value of $3,500). Travel will be from a major airport reasonably close to the Winner’s home address selected by 3Dconnexion Inc in its sole discretion. Hotel accommodations are double occupancy and at a location selected by 3Dconnexion Inc. in its sole discretion. 3Dconnexion Inc. is not responsible for flight delays or flight cancellations and/or if the conference and exposition is cancelled or rescheduled for any reason.
All incidental other expenses (such as meals, tips, hotel room charges, taxis to/from airport, etc.) shall be the responsibility of the Winner. No cash equivalent or alternative prize will be awarded. Federal, state and local taxes are the responsibility of the winners. Prize will be delivered to the Winner. Return of the prize as undeliverable will result in forfeiture of the prize and selection of alternate winner.
5. BINDING EFFECT. By submitting your entry you agree to be bound by these Official Rules. All federal, state and local laws apply.
6. GENERAL CONDITIONS OF PARTICIPATION. 3Dconnexion Inc.’s decisions are final on all matters related to this promotion. 3Dconnexion Inc. and its service providers are not responsible for incomplete, lost, late, delayed or garbled registrations or entries, incorrect or inaccurate capture of entry information, including but not limited to technical malfunctions, human or technical error, omission, interruption, deletion, defect or failures of: any telephone or computer line or network, computer equipment, software or any combination thereof.
Only the fully completed online application will be accepted. All applications submitted become the property of 3Dconnexion Inc. 3Dconnexion Inc. reserves the right, without prior notice, to terminate this Promotion, in whole or in part, or modify this Promotion in any way, and for any reason, including without limitation, if 3Dconnexion Inc. determines in its sole discretion, that fraud, technical failures or any other factor beyond 3Dconnexion Inc.’s reasonable control impairs the integrity of the Promotion. 3Dconnexion Inc. reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the application or voting process or to be acting in violation of these Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion is a violation of criminal and civil law, and should such an attempt be made, 3Dconnexion Inc. reserves the right to seek damages from any such person to the fullest extent permitted by law. 3Dconnexion Inc.’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
By participating in this Promotion, the entrants release and agree to hold harmless 3Dconnexion Inc. and its affiliates, dealers, subsidiaries, their service providers, agencies and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies, from any and all liability with respect to acceptance, possession or use (or misuse), or failure to use any matters arising out of or relating to this Promotion or any prize.
7. PUBLICITY RELEASE. Except where prohibited by law, acceptance of a prize shall constitute the winner’s agreement that 3Dconnexion Inc. may use the name, address, voice, likeness and prize information of each winning entrant for promotional purposes without further payment or consideration. 3Dconnexion Inc. may also post the winner’s name on its websites or announce via other social media outlets including Facebook or Twitter without further compensation, unless prohibited by law.
8. SPONSOR. This promotion is sponsored by 3Dconnexion Inc. with North America headquarter offices at 330 Bear Hill Rd, Suite 301, Waltham, MA, 02451, USA.
9. COPY OF RULES/WINNER. 3Dconnexion Inc. will post Winner on its websites and you may receive a copy of the rules or name of winner by sending a self-addressed, stamped envelope to 3DCONNEXION PROMOTION FOR Autodesk University 2011 at address of Sponsor prior to November 20, 2011. Residents of Vermont may omit return postage.
10. DISPUTES. Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this promotion, other than the administration of the promotion, shall be resolved individually, without resort to any form of class action, and exclusively by a court having competent jurisdiction located in Middlesex County, Massachussetts, U.S.A.; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys' fees; and (c) under no circumstances will registrant be permitted to obtain awards for, and registrant hereby waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and 3Dconnexion Inc. in connection with the promotion, shall be governed by, and construed in accordance with, the laws of the State of Massachussetts, U.S.A., without giving effect to any choice of law or conflict of law rules.
